These Terms and Conditions (“Terms”) govern your use of the PeppyTiger website and services (“Services”). By accessing or ordering through our platform, you accept these Terms. If you do not agree, do not use our Services.

• “PeppyTiger,” “we,” “us,” “our” — PeppyTiger Inc., registered in Delaware, USA.
• “User,” “you,” “your” — Any individual or entity using our Services.
• “Content” — Drawings, names, photographs, or other materials submitted by you.
• “Product” — Personalized printed book created from your Content.

You must be at least 18 years old or have valid parental or guardian consent to use our Services.

You are responsible for your account and all activity under it. All information you submit must be complete, accurate, and lawful.

You may upload drawings, names, photographs, or other Content for personalization. By submitting Content, you:

• Confirm you are the legal guardian of any child depicted or have explicit, documented permission to use and share their likeness or name.
• Grant PeppyTiger a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and store the Content solely to create, fulfill, and improve your order, provide support, and (only with additional consent) marketing purposes.
• Assume full legal responsibility for the Content's legality, safety, and copyright status.

You must not upload any Content that:

• Infringes copyrights, trademarks, or privacy rights
• Contains nudity, hate speech, abusive material, or third-party logos
• Shows children in unsafe, compromising, or inappropriate contexts

PeppyTiger may remove or reject any Content at its sole discretion, and report unlawful material to the relevant authorities if required. We do not edit your Content.

All non-user-generated elements of our platform (designs, code, graphics, content) are owned by PeppyTiger and protected by applicable intellectual property laws. No rights are granted beyond what is required to use the Services.

You are solely responsible for reviewing all personalization details before submitting your order.

Personalized orders cannot be canceled or changed once sent to production. There is also no right of withdrawal under EU law (Directive 2011/83/EU, Article 16(c)) for personalized goods.

For non-personalized products, cancellation is possible only before shipping. Once shipped, the sale is final.

If you notice an error, contact us immediately. We may assist at our discretion but are not obligated to amend or refund.

Delivery estimates are not guaranteed. You are responsible for accurate delivery details.

PeppyTiger is not liable for delays due to carriers, customs, or force majeure events.

Shipping fees are calculated at checkout and vary by destination and provider. Shipping is not handled by PeppyTiger.

All personalized items are non-refundable and non-returnable, unless defective or incorrect due to our error.

Due to the personalized and user-controlled nature of our products, all sales are final.

Our platform allows you to upload, edit, preview, and approve all images, names, and content before placing an order. As such:

• You are solely responsible for the accuracy, quality, and suitability of all submitted or modified content.
• We do not review or adjust the submitted images or personalization details.
• Once your order is submitted, no refunds, exchanges, or returns will be granted — including for:
  • Low-resolution or poorly cropped images
  • Incorrect names or details
  • Layout, design, or appearance not matching expectations
  • Subjective dissatisfaction by the recipient or child

We do not offer refunds or reprints for any issue resulting from user-submitted or user-edited content.

The only exception is if the physical product arrives with a clear manufacturing defect (e.g., missing pages, severe print damage, incorrect binding). In such cases:

• You must contact us within 14 days of delivery.
• You must provide clear photographic evidence of the defect.
• PeppyTiger will determine, at its sole discretion, whether a replacement or refund is warranted.

We disclaim any responsibility for the emotional or aesthetic expectations of the customer or child. All content, including the final product's appearance, is the result of your direct input.

Prices are in Euros (€) and in dollars ($), depending on the area, including applicable VAT unless otherwise stated. Payment is due in full at the time of order using available methods.

We process personal data in full compliance with the EU General Data Protection Regulation (GDPR).

11.1 What We Potentially Collect

Depending on your use of the PeppyTiger platform, we may collect the following categories of personal data:

Account Information

• Full name of parent or legal guardian
• Email address
• Password (hashed and encrypted)
• Account preferences and settings

Order and Billing Information

• Delivery address
• Billing address (if different)
• Telephone number (optional, for delivery support)
• Payment confirmation data (handled via third-party processor; we do not store card details)
• Order history and transaction metadata

Personalization and Uploaded Content

• Child's first name or nickname
• Uploaded drawings, artwork, or illustrations
• Uploaded photographs of the child
• Text or messages added by the user for personalization
• Any other input voluntarily submitted during product customization

Technical Data and Usage

• IP address
• Browser type and version
• Device type and operating system
• Pages visited, actions taken (clicks, edits), and time spent on the site
• Cookies and session data (see our Cookie Policy)

Communication Data

• Messages and support queries
• Emails exchanged with our support team
• Chat transcripts (if applicable)

Consent Records

• Timestamp and proof of user's agreement to these Terms and the Privacy Policy
• Parental or legal guardian consent for processing children's data (where applicable)

11.2 Purpose of Processing

a) Order Fulfillment & Contract Execution

• To allow customers to personalize and order products
• To process payments and confirm transactions
• To deliver the final product to the customer
• To provide status updates and shipping notifications
• To communicate regarding order issues or confirmations

b) Customer Support & Technical Assistance

• To respond to inquiries, complaints, or product issues
• To troubleshoot platform-related bugs or user-reported errors
• To provide guidance on using personalization features

c) Service Improvement & Analytics

• To monitor platform usage and improve UX/UI
• To analyze purchase behavior, user journey, and conversion rates
• To run internal data reports to improve personalization flow and performance

d) Legal, Regulatory & Tax Compliance

• To generate and retain records for tax authorities and auditing
• To comply with applicable e-commerce, consumer protection, and data privacy laws

e) Marketing and Communications (Consent-Based)

• To send promotional emails or product updates only if the user has explicitly opted in
• To request reviews, feedback, or participation in surveys (opt-in)
• To display anonymized or user-approved personalized product examples (with consent)

f) Security and Abuse Prevention

• To detect and prevent fraud, abuse, or unauthorized access
• To secure our platform against attacks or content violations

If consent is given, user-submitted content such as drawings, names, and photos may be used to improve and train PeppyTiger's internal personalization models (including machine learning systems).

We do not sell or share personal data with third parties beyond what is necessary for production, delivery or data training.

11.3 Legal Basis (Article 6 GDPR)

PeppyTiger processes personal data in accordance with applicable data protection laws, including the European Union's General Data Protection Regulation (GDPR) and the Delaware Personal Data Privacy Act (DPDPA). Our data processing activities are grounded in one or more of the following legal bases:

Consent

We process personal data when we have obtained clear and affirmative consent from the individual. This applies to activities such as sending marketing communications, using personal data for personalization features, or processing sensitive information.

Contractual Necessity

Processing is necessary for the performance of a contract to which the individual is a party, or to take steps at the request of the individual prior to entering into a contract. For example, we process personal data to fulfill orders, provide customer support, and deliver our services.

Legal Obligation

We process personal data to comply with legal obligations to which we are subject. This includes obligations related to tax laws, accounting requirements, and other regulatory compliance measures.

Legitimate Interests

We retain personal data for as long as it is necessary to fulfill the purposes outlined in this policy, including but not limited to:

• Order fulfillment and customer service

• Internal analytics, service improvement, and system auditing
• Product enhancement and training of future personalization models (e.g., machine learning), where permitted by law

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including satisfying any legal, accounting, or reporting requirements. The specific retention period depends on the nature of the data and the context in which it was collected. Once the data is no longer needed for these purposes, we will securely delete or anonymize it, unless we are required by law to retain it for a longer period.

You may request deletion of your personal data at any time by contacting info@peppytiger.com. We will comply unless we are legally required or otherwise entitled to retain it.

Where data is used for model training or AI improvement, we rely on explicit consent at the time of upload.

11.5 Children's Data

We do not knowingly collect personal data directly from children under the age of 13. All data, including uploaded names, drawings, and photographs depicting children, must be submitted by a parent or legal guardian, or someone with documented legal authorization to act on their behalf.

By uploading any image, drawing, or content involving a child, you confirm and warrant that:

• You are the child's parent or legal guardian, or have been explicitly authorized to act on their behalf
• You consent to the processing of the child's personal data in accordance with this policy
• You accept full responsibility for the legality of the submission and use of such content

PeppyTiger relies entirely on the accuracy and truthfulness of this confirmation. If you do not have the legal authority to upload a child's data, you must not use this service.

11.6 Your Rights (Under GDPR)

You have the right to:

• Access or rectify your data
• Request data deletion
• Object to processing
• Withdraw consent

We are committed to ensuring accessibility for all users and are actively working to align our platform with international accessibility standards.

Our Services and products are provided “as is.” We make no warranties, express or implied, including merchantability or fitness for purpose.

To the maximum extent permitted by law:

• PeppyTiger shall not be liable for indirect, incidental, punitive, or consequential damages.
• Total liability is limited to the amount paid for the product in question.

We are not liable for failure to perform due to circumstances beyond our control, including natural disasters, war, labor issues, pandemics, and transportation or supplier disruptions.

These Terms are governed by the laws of Delaware, USA.

Before initiating legal action, both parties agree to attempt resolution via informal discussion. Failing that, disputes shall be resolved via binding arbitration under the American Arbitration Association. Both parties waive class actions and jury trials.

We may revise these Terms at any time. Updates take effect upon posting. Continued use of the Services indicates acceptance of the updated Terms.

We may use your personal data for direct marketing purposes, including and not limited to:

• Informing you about new products, services, promotions, or offers
• Sending newsletters or updates
• Providing personalized recommendations, where appropriate

You have the right to withdraw your consent or opt out of direct marketing at any time. You can do so by:

• Clicking the “unsubscribe” link in any marketing email
• Updating your consent preferences in your account settings (if applicable)
• Contacting us using the details provided in Section 19

Your withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
